Dismissal during the trial period

From May 2019, only an employer with 19 or few employees can employ someone on a trial period for the first 90 calendar days of their employment.

Most often, we are faced with an unfortunate situation, where a migrant has obtained a closed visa tied to an employer and gets dismissed during the initial 90-day period. This leaves the employee in a fix, since they are then staying in New Zealand breaching their visa condition and finding a new job immediately can be quite daunting.

Fortunately, INZ has come up with a special category of visa for such migrants – a visitor visa for 3 months, where the applicant has sufficient time to sort out their pending matters. Partners and dependent children can also be included in this application; since technically if the supporting person is in breach of visa condition, that means the whole family will be affected by the same.
